Labour law in South Africa protects employees’ rights and details the obligations and responsibilities of employers.   

If employees have commenced strike action and the employer requires assistance to encourage the employees return to work, the employer will need to consult with a specialist labour attorney who will provide the necessary legal assistance, guidance and representation. The labour attorney will also be able to identify whether the strike is a ‘protected’ strike in terms of law, or if it is in fact an ‘unprotected’ strike - from which they will be able to advise the processes going forward.

On the other hand, if employees are planning strike action (with or without trade unions), legal assistance and guidance may be needed by the employees to make sure that the strike is legal, legitimate and ‘protected’ in terms of the Labour Relations Act.
